The 1st District Court of Appeals has issued is decision on the constitutionality of the Independent Medical Review (IMR) in California Workers' Compensation. In the case of Stevens v. Workers' Compensation Appeals Board, the District Court held that the IMR process is constitutional. The Court found the process fundamentally fair and that it provides injured workers "sufficient opportunities to present evidence and be heard."
