We received an interesting post by Mark Kahn, the WCAB’s prior Associate Chief Judge, about the case of Traspero v. North American Pneumatics. The issue that comes to mind from a defense perspective is the fact that we will have a very difficult time obtaining an agreement from the applicant’s attorneys to allow AMEs to review sub rosa films. We will most certainly have to go the extra step of petitioning the WCAB for an Order for the AME to review the films and we may need to have a hearing onImage may be NSFW.
